Today the U.S. District Court in North Dakota placed EPA’s Waters of the United States (WOTUS) rule on hold. In granting the preliminary injunction, the District Court found that the 13 party States were likely to succeed on the merits of their claim that EPA’s rule is unlawful.
“I am thrilled that Chief Judge Erickson agrees EPA’s WOTUS rule should be enjoined,” said RAGA Chairman and Florida Attorney General Pam Bondi. “EPA overstepped its authority, again. The EPA should not be permitted to intrude unlawfully on state authority and burden farmers, businesses and landowners."
